    Did you know that PPI had been added to your agreement by Egg? If you had no idea that Egg had added PPI to your agreement, it could have been done without your consent. All costings relating to the PPI should have been explained to you by Egg. Did Egg make it known that that some of the PPI premium may have been paid as commission?     Were you made aware by Egg that you could cancel the PPI policy? Egg should have explained that you had a cooling off period and could exercise your right to cancel the PPI policy within that time. Were you made aware by Egg of any circumstances or exclusions where you would not be successful in making a claim? If Egg had not made clear any exclusions or circumstances that would prevent you from claiming, you may have been mis-sold Egg PPI policy. Were any enquiries made by Egg if you had other PPI cover that would cover repayments?

    Egg has a responsibility to find out if you had sufficient PPI cover elsewhere. Were you pressured into purchasing the Egg PPI policy? Egg should have looked at your personal situation to assess if you would benefit from having PPI without any pressure or hard-sell. At the time of taking out the PPI policy with Egg, did you have any pre-existing medical conditions? If you had any pre-existing medical conditions that meant you could not have worked for the duration of the Egg PPI term, you would not be covered by the Egg PPI policy.

    Was it implied to you that Egg PPI was necessary to get the finance? Did Egg PPI have an upper age limit, if so, were you older than it? If Egg PPI specified an age limit for cover and you were older than this, you would not be covered by the policy. How long was the term of Egg PPI, was it was shorter than the term of finance agreement? Did Egg explain that there would also be a period of no cover towards the end of the finance agreement?

    Insurance providers paid banks and other lenders a commission for every PPI policy sold. The greater the number of policies sold, the more commission that is earned by the seller.

    Since the Plevin case, customers could complain about the level of commission paid for, that was not previously disclosed when the policy was sold to them. If the commission was high you may be entitled to compensation regardless of if you were mis-sold the PPI or not. He awarded the claimants all their high commission payments back plus interest. The case of Doran does not set a precedent, like Plevin case does, as it was decided in a lower court and may yet be appealed by Paragon Personal Finance.

    Customers who have already been successful in their claims for mis-selling cannot claim under the Plevin rules. This will still apply after the recent Doran case. Lenders will only consider claims for undisclosed commission if the customer has been rejected for a mis-sale. However, if you had PPI in the past you may not have been mis-sold the policy, but you may still be due a pay-out.

    Banks now need to take into consideration the Plevin rules which means a previously rejected claim could be successful. If your mis-sold PPI claim was previously rejected, you may be able to complain about the commission if:.     I opted for mediation, and it played out very similarly to other people's experiences. In the first call I outlined my case, and I referred to the Contracts Rights of Third Parties Act as the reason to why I do in fact have a contract with them. In the second call the mediator came back with an offer of the full amount of the phone and postage £ I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible.

    I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.

    In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink. To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.

    I cited the reasons for this as being fined by the FSA and that the policy was not in my best interests. I received what appears to be the standard response of card purchased online, Egg do not provide an advisory service as part of online sales process, I was asked to read the terms and conditions governing the policy and specifically confirm that I agreed to them.

    In addition, a copy of the terms and conditions were sent out prior to purchase of the policy being completed. They also enclosed a copy of the 'real time application' which also appears to be the standard response. Interestingly it shows my length of time in my current employment as being 6years 6 months, which as I was 20 at the time of the application would have meant I had been employed in a telebanking centre since the age of about 14!

    I initially gave up on this matter thinking that there would be no point in pursuing it but then decided to challenge the decision in May with the following response You state that the insurance was selected via an internet application and that I had to confirm that I agreed to these terms and conditions, which were confirmed via a paper agreement which I was required to sign prior to the policy being completed. I have examined my own copy of my credit agreement and there is absolutely no mention whatsoever on this agreement of any insurance products or payments regarding any insurance products.

    I was required to sign this agreement and return it to yourselves accepting the credit card. I signed the agreement and returned it to you, however at no time have I signed to accept any insurance on this credit card.

    Therefore I do not accept your response, and challenge your statement that I signed for and accepted this insurance. Also I would like you to provide proof that the payment protection insurance for this agreement was an opt-in option and not an opt-out box automatically checked during the application process, as I do not believe that this product was a selection that I made during the application process.

    You would not have been able to proceed with your application until you had agreed or gone backwards and selected no. Full information was provided on website to enable you to decide if insurance right for you blah blah and please find enclosed an example of the screen you were presented with - this letter was accomplanied by a printout of an Egg screen with sections on additional card holders, PIN and would you like to ensure your card balances.

    They also state that a paper copy of the terms and conditions were included with two copies of my Egg card agreement, of which I signed one copy. Apparently this shows that I received paper documentation prior to any premiums being added to my account. This is in line with distance selling regulations, which they have then gone on to detail. At the close of the letter they they state that the "CRP is a seperate insurance and is not detailed on your Egg Card agreement" Is there any point in pursuing this matter any further?

    Doesn't appear that Egg are going to budge. Hi there The FOS to what I am aware of are dealing with loads of these complaints, especially online selling via EGG, and are getting used to their tactics. I would keep trying, by either writing back to them if this was not the final response, and tell them you want this reconsidered, as you stand firmly on your reasons of why you were mis sold the policy. Then in the final letter they should give you the details of the FOS if eligible to go this direction.
